Legal Question in Wills and Trusts in Florida
Upon death of both parents, would a 16 year old be able to decide where to live?
We have a will in which we have appointed a legal guardian for our 16 year old but he does not live where we currently live. If both of us should die, we would like our child to stay here in this area to finish HS. We have good friends that live here and would take her in for 2 years. Are people who are not the legal guardians allowed to take in a child if they have the approval of the legal guardian and how do we make sure that our wishes will be honored? Do we need to put this in our will or simply tell the guardian of our wishes? Would our child be able to petition for where she would like to live?

Your child could not petition for anything. Your will should provide instructions for your guardian and appoint a successor guardian for your daughter to be appointed if the guardian fails to follow your instructions
