Legal Question in Wills and Trusts in Florida

Deceased exhusband with no will

Former husband died with no will. He remarried and his widow will not give items back that were taken from my home without permission. (even ordered in divorce decree) Our children would also like some of his personal effects but wife refuses to cooperate. Former husband was also in arrears for child support 3 months prior to his passing. Wife received his income tax return and stimulus which included money he claimed for our son. How do I proceed if I have a claim against his wife for his estate?

Re: Deceased exhusband with no will

You could file a claim in probate. If she has not initiated a probate, any of your chidren could do so by filing a Petition for probate. They would need an attorney to do this.
