Legal Question in Wills and Trusts in Florida

Depletion of Minor's Trust Fund

What if any, are the penalties when a trust fund which as established 15 years ago has been withdrawn from the bank at periodic intervals approximately 12 years ago by the child's parent?

The child is just turning 18 years of age. The

guardian parent did not request permission from th court to use this money and has now received a letter to go before a judge.

Re: Depletion of Minor's Trust Fund

If the guardian depleted the fund without permission from the court AND used the funds for own use,it could be prosecuted as a felony.

You have the right to bring a law suit to recover.

There is probABLY a surety bond on file that would pay you and then go after a guilty party.

We may take this on a percentage basis/or fees could be awarded in the action on the bond. We can handle this anywhere in the State. JMC
