Legal Question in Wills and Trusts in Florida
Disinheritance of children
My husband wants to change our wills, disinheriting our children and leaving everything to a charitable organization. I do not want to do this but am being coerced. He does not want the childen's spouses to benefit from anything we may leave. Is there a way to do this without disinheriting the children?

If you do not want that provision in your will, then have your will drafted as you wish.

Of course if he dies first, you could then change your will. Leaving that aside, however, if your husband does not want anything to go directly to a child's spouse, you and he could provide that everything goes into a trust at death(or stays in a trust, if you set up a living trust), with the children receiving only the income (or maybe also part of the principal), and that at the children's deaths their share goes to charity.
