Legal Question in Wills and Trusts in Florida

Disinherited Spouse

My husband died as an active duty AF member. He had a will and he disinherited me ''to the fullest extent of the law'' and left his estate to his three children. He had a SGLI life insurance policy and listed ''by will'' as the beneficiary. The insurance policy has been added to the probate. Am I entitled to my ''elective share'' per Florida statutes?

Yes, if Florida law applies.

Re: Disinherited Spouse

I agree with first answer regarding FLorida law on elective share. I only write to add that you have a limited time to make the elective share election so you should speak with a Florida attorney as soon as possible to be sure you do make a timely court filing for your rights under Florida law.
