Legal Question in Wills and Trusts in Florida
What Document is needed to carry out my wishes in case of my death?
I have no assets for a will, but I want to know what type of document I would use to give the person that is the beneficiary of my life insurance the power to carry out my wishes at the time of my death. This person knows exactly what I want at the time of my death, and will use my life insurance to carry out my wishes. This person is not a blood relative, but I have a sister who wants my beneficiary to be able to carry out my wishes.

You need a living will (so this person can attend to any matters should you become ill, hospitalized, etc.), perhaps a power of attorney for the same reasons, and a Will. A Will is the only document that can carry out intentions after death. If you are thinking of something specific, like funeral arrangements, ask a funeral home what they would require. Make as many arrangements as possible in advance so that your beneficiary has no need of the courts' assistance.

There isn't a document that would require someone who is the beneficiary of life insurance proceeds to do anything. A life insurance policy is seperate from probate. The funds go directly to the beneficiary.
