Right of Election

How does one go about filing a claim for the right of election?

You can go to an attorney and have him prepare and file it, or you can just write out on a piece of paper that you wish to exercise your right of election as a surviving spouse, sign and date it, include your address, send the original to the clerk of the court where estate is being probated, and send a copy by mail to the attorney for the personal representative. Be sure to do so right away, as your time is limited. Check with an attorney to determine what the time period is.
