Re: Estate Settlement & Creditors Claims

Q. Once an estate has been settled in the state of

Florida, what is or is there a time limit for

when someone or a corporation can go back on the

estate to collect an unpaid bill?

A. In Florida there is a two(2) year period for

creditors to collect what is due them. However,

if you open an estate and publish a Notice to

creditors and send certified notices to them,

then their time to file a claim is shortened to

three months after the first publication. Once

the estate is closed, then all claims of creditors

should have been barred unless there was fraud.
