my mother left living right to her former husband,he is not paying the morgage onthe house and will not aloud his children in the home and he no longer lives there move in with another womencan our probate atty ask the judge for a actjionfor waste abondament action conversentive, my atty says i need a litigator so he can quit deed it to us, since he not there for over 10 month and all my mother belongs are still there and she left all the furniture to the daughter. I need help I spoke to an atty they want $20,000 retainer. I'm the daughter and i need to resolve this matter and i live in the state of New York Can I file paper from NY. please reply thank you. nw the house is in foreclouse, and this atty says he can't do nothing everytime i turn around it is costing me money . Ther is something can be done to remove him from is right since he is not taken care of his obligation as an living spouse.
