How to become executer of estate?

My brother died in a nursing home in

florida 6 months ago. He was a

veteran, had no will, no assets, and

was appointed a legal guardian from

the state because he was not

mentally or physically able to take

care of himself. I am the only family

as our parents are deceased and he

never married or had children. Social

security called me and said they are

awarding him money for a special

disability workload (undisclosed

amount at this time) but that I need

to get myself appointed as executer

of his estate. How do I go about

that? Any suggestions on where to

start? I live in Ct.

It is called a personal representative in Florida. You must file a petition to be appointed in the Circuit Court of the county where he lived. Good luck.

You will need an attorney to help you file the petition in the county where your brother resided.

My condolences on your loss. First you will need to open a probate of your brother's estate and ask the court to be appointed as Personal Representative. This should be done in the county where your brother lived at the time of his death.

You should contact an attorney in the area where your brother lived to start the process for you and oversee the probate.
