Legal Question in Wills and Trusts in Florida
Executrix of will
Parent passed without a known will. I had Power of Attorney, which parent believed would cover as a will. Please advise how do you become Executrix, haste of the estate to continue handling estate until it is probated?

A power of attorney does not operate as a will. To open probate, just see a lawyer. As one of the children, you can become the personal representative.

Hello: I read your question and the one response. You do need to file a Probate case if there are assets, debts, other siblings, or spouse. The amount if the assets determine which type of Probate case to file.
If my office can be of any assistance in No. Fla., please give us a call. Tom Rosenblum
