Legal Question in Wills and Trusts in Florida

fake will

I received a copy of my fathers will today. It consists of 4 pages, it is plain to see the person who signed the top 2 pages that gives everything to my stepmother, did not sign the last 2 pages , the last 2 pages of document resembles my fathers signature on documents on a county website. What are the consequences of such and action. please advise

Re: fake will

If the will has not been probated (proved), you can dispute the probate on the issue of authenticity (there are other grounds). You can arrange for a document expert to review the will to see if the Will is consistent throughout, i.e. same font, same type of paper, etc. If the will was drafted by an attorney, you may contact the attorney to see if there is a copy of such Will in the law firm's file.

These are examples of what must be done in a contest to prove or disprove the validity of a Will in a probate proceeding. Will contests are neither cheap nor easy.

You should contact local counsel regarding the details of the options available to you.

Re: fake will

The will may not be valid. You will need to see a lawyer to see if the will can be set aside and what the consequences are of such action.
