Family Inheritance

My mother is almost 80 years old. From what I gather, she has no will. She says she does not need a will because if she ever has to go in a nursing home, she will need all her money for that. She has probably about 1 million dollars. What can I do to protect the estate for myself and my brothers in the event of her death?

Protect it from what? If she dies without a will, and has no husband, her entire estate passes to her children, the same way it would pass to them if she had a will stating the same. There is no estate or inheritance tax since she has less than $2 million.
