Legal Question in Wills and Trusts in Florida
My father died in Arkansas " intestate". He owned the home before he married the current wife. The house is not in the current wife's name. I am his only heir. Is there a spousal allowance of $30,000 to the wife before the heir receives the inheritance?

First off where is the house? Did he live in Arkansas? If so you need an attorney for that area. If he lived here - different matter. On the off chance he just owned property in this state, you need to an ancilliary probate because he has property. IN our state, the wife is entitled to a spousal elective share however, if the house belonged to your father prior to his death and there was no comingling of the funds, it is possible that you are the only heir. Need more info
If he lived in Ark. you need Ark. counsel to administer the estate there.
