my father died in nj a few months back
have not heard from his attorney
i am only living child
is his attorney required to notify me

why don't you call him. If your dad died and he has no spouse and you are the only living child, you could be the only heir. However, if your dad left a will, and you had siblings who had children, you could be sharing with them.

No. If you are his next of kin, it is your responsibility to have the estate go to probate.
