my father died without a will and was not married, what statute makes me legal heir?

You must file for Administration of his estate if he owned assets.

It is the Intestate Succession laws that just changed October 1, 2011. Under the circumstances, the legal heirs would be his children, or his grandchildren of a deceased child.
If there is a probate proceeding you will be required to use an attorney.
