Legal Question in Wills and Trusts in Florida

my father recentley passed. my sister is the executor. my father devided his estate equally. I live next door to my father and my sister has removed all his persnal properties, like computers guns all his trucks, forklifts, ext. She tells me their hers and my dad wanted her to have them and will not tell me anything. my father has a lot of rentals and property. she said we will devide only some and now for some reason she want talk to me. not only is this wrong but i feel violated. are wills no good just a piece of paper? i am single and cant afford a lawyer at this time. if wills cant be followed through i would like the public to know so things can be changed.also she has went to the bank and taken some kind of monies out with my fathers death certificate, i think it was life ins. policy of some sorts.can you advise me?

You have rights, and as hard as your sister tries, she cannot waive them for you.

For her to make a statement about what is hers, I presume there is a Will. You are entitled to a copy of it, and if she doesn't give you one the court can arrange for you to get one.

If there is probate, you will get a copy of the Inventory and the right to an accounting.

My suggestion is to talk with an attorney. Many, like me, do not have an initial consultation fee. Maybe you can work out a solution to get representation.

Go to UR local Legal Aid Office and apply 4 a free lawyer. If U qualify, the lawyer can recover fees from UR sister or the estate. Once U show UR sister tyhat U R not going to lie down & take it, hopefully she will do right by U & the law.

I suggest you retain local counsel. I am sure you could find an attorney willing to handle the matter with reasonable rates. If she was the beneficiary of the life ins. policy that would not be part of the estate.
