Legal Question in Wills and Trusts in Florida

My fiance was a claimant on his father's estate. His father's will was prepared in New York and my fiance was to receive 50% of his father's estate, amounting to approximately $100,000. His father's will, and my fiance's, have been confirmed as legal by attorneys in New York and Florida, where my fiance resided until his death May 2009. My fiance's will lists me as the benefactor and executor. Neither he, nor I, have received any monies from his father's estate, of which his brother is the executor . I am now the executor and beneficary of my fiance's estate. He had multiple bills including medical, IRS back taxes, school loans and credit card debt. Even if I receive the claim for him against his brother for the amount due from his father's estate, that amount will not cover all of these bills. How do I decide who will receive benefits? What is my recourse?

You need to find out what is going on in father's estate. Check the court file, contact the estate attorney and/or the personal representative.
