There is always a filing fee for probating an estate.

It depends on the County. Many times there is no fee or a very minimal fee for depositing a will, but if you need to open probate, there is a more expensive filing fee. Because your husband has been deceased for more than 2 years, you can file Summary Administration (an abbreviated and less expensive form of probate), if probate is necessary (probate is not needed for all property). If probate is necessary, and there is more than one beneficiary, an attorney is required in the State of Florida. Depending on the size and complexity of the estate, attorney fees and filing fees vary.
