Legal Question in Wills and Trusts in Florida

Find copy of trust documents

My husband's grandfather died leaving a life estate (to his mother) of beach property. He was always told the remainder would be split between himself and siblings. Sadly one of his siblings is draining the mother's assets away and completely controls her spending. The mother is now saying that the estate really goes to her and that my husband is not part of it. How can my husband find the original trust documents to determine exactly who the reaminderman is? Can a trust be changed postumustly by his mother? His mother had him sign some unknown documents when he was around 18, he completely trusted her at the time, but now must question her actions. How can he find out what this document was? It would have been around the same time of his grandfather's death in 1981. He has contacted the trustee several times and cannot get a returned phone call. The trustee is also his mother's long standing attorney, though we have had business with other attorney's in the firm. We have a document showing the life estate and mentioning guidelines of how the property is to be dealt with during the life of his mother, but there is no link to the original estate. Pleas advise - thanks

Re: Find copy of trust documents

If it was filed with the court, they will show it to you. If not, you must get a copy from the law firm. Write a letter to the law firm , certified mail. If no reswponse , retain your own attorney.
