Legal Question in Wills and Trusts in Florida
How do I find out if I am in the will?
If a relative dies, and you think you might be in the Will, but suspect that you may never be told about it due to Family problems, how can you legally find out if you were really in the will or not? Are you legally entitled to what was left to you in the Will even if the executor of the will has no intention of telling you one way or the other. How can you find out in the state of Florida. Thanks.

If the will is probated it will be filed with the court in the county where the deceased lived. You or your attorney should be able to see it.

Distribution under the will cannot be made until it is filed with the court for probate. When it is filed, it becomes public record. There are legal remedies in case the estate is settled without probating a valid will.If you are named as a beneficiary in a valid will, you are entitled to the bequest regardless of the executor's intentions. Note also that it is the executive's duty to find and notify beneficiaries.
