my father died 4/15/03. He had a will but left it up to my step-mother of whether or not to give me the land. She basically sold everything and I want to know if I can still fight for the 1 acre remaing of which my fathers ashes are buried. she has childeren and i dont think its fair that if she passes the land would go to her bio-children instead of me which this land originally belonged to my mother and father. Your title was never mentioned in the question so I have no idea what you are alleging. If dad did not bequeath the property to you in his will, then you have no claim to it. If it was the homestead of dad and his wife (your step mother) then she has a valid claim to it which a court will be loathe to change. Once it becomes hers, she has the right to devise it to whomever she deems appropriate.
