Legal Question in Wills and Trusts in Florida

What form?

I am married to my second wife. I have a grown child by my first wife but none with this wife

I am looking at FindLegalForms-dod-com but will accept directions to any seller.

I need to know if my present wife and I should do a ''family'' will or separate wills.

Re: What form?

I agree separate wills are preferable and I also agree that will forms are a risky proposition -- I have seen them do more harm then good. A simple will should not be cost prohibitive, you should call some local attorneys and see what they would charge. Good luck.

Re: What form?

Seperate wills are easiest in my judgment.

Re: What form?

There are or may be additional factors to consider before this question can be properly answered. For example, does your current wife have any children? What assets do you have jointly and individually? What are your wishes with regard to the assets?

The best thing for you to do is find an attorney to discuss your estate planning with. The generalized forms found on the internet do not typically address most needs, and can leave the estate in shambles.

If you insist on using the forms on the internet, you should carefully read the disclaimers of the websites and the forms pages to ensure that the forms you are using are acceptable in your state (in your case Florida). Many times these do-it-yourself kits are not applicable to Florida, New York, and other states.
