Gift Annuities

A donor to our not-for-profit purchased a deferred gift annuity in Nov. 2007 for 1.6 M.....she initially funded it with 10k and was to complete funding by the end of Dec 2007. She died Dec 23. Do we have any claim on the 1.6m if the executors are in agreement.
