Greedy Sidling

My grandmother died and left the house for all of us(her grandchildren),one brother toke-off with six months worth our mortgage money,caused us to go into forclosure without our knowledge. We managed to refinance & save the house. He refused to take his name off the house,now the house is being sold and he still gets a cut,even though he hasn't been living there and toke off with our money. Can we the 3 grandchildren sue for our money lost?

Of course you can sue him for the money owed. Is he good for a judgment? However, he may not agree to sign the deed over to a purchaser. If so, you will court intervention to compel the sale and distribution of the funds. Good luck.

This brother took money from the estate that he was not entitled to and you can bring a lawsuit against him seeking return of these funds. What you cannot do is simply withhold the money without court approval because you think you should.
