Legal Question in Wills and Trusts in Florida

four and half years ago my husband died, his daughter is the PR, I got an attorney and filed in fl. For elective share. Daughter took the money and my lawyer has gotten me nothing, not even my family allowance. She has not paid the IRS the back taxes owed and has not put the property up for sale. My lawyer keeps promising but does nothing. What can I do?

Contact the Florida Bar and file an immediate Complaint. Sounds to me if you let this continue, there will be nothing left for you to claim.

This sounds odd and unless there is some extraneous litigation going on there should be no reason the probate is taking so long. At the very least you should go to another attorney's office and go over the file and see what is going on. If there is no reasonable explanation once speaking with counsel then I might suggest what counsel has said above. If there has been a failure by your lawyer in one or more respects then you might consider seeing an attorney who specializes in legal malpractice to see if some of your loses can be recouped in that manner. Act fast as legal remedies can sometimes be extinguished due to the lapse of time. I'm sorry you're going through this and hope this helps.

There also may be no Estate assets and that is the problem. Suggest you either have a sit down with your attorney OR you hire a new attorney.
