Homestead/Life Estate

Is a surviving spouse entitled to ''life estate'' to a home she lived in, only her spouse owned, but both parties moved out of 1 month before the spouse died? The surviving spouse is not included in the will. The deceased spouse owned the home for 30 years, the surviving spouse lived in the home for 5 years.

If it was still the homestead she is entitled to a life estate. As the spouse she is also entitled to a share of the estate even though not mentioned in the will. If she needs representation in Florida please feel free to contact me. Good luck.
