Legal Question in Wills and Trusts in Florida

Inheritance dispute

My siblings and I were left money to be dispersed by our father. We received part but I have yet to recieve the final sum. He willnot give up the final sum because he doesnt like the fact I am getting divorced and have left New York state. He supposably has given her some of the money and will not give me any. I have papers from him on what the distribution was from the begining. ALSO , papers of what has been sent out. I have to sue him in order to get this money .I do not have the money to sue however. Help.

Re: Inheritance dispute

Your question raises many more questions in order to provide a response. Was the inheritance stated in a Last Will? Has the will been admitted to probate? If in probate, what stage? You may be able to file an objection to the proposed distribution under the will for a small fee. Or, if your claim is upheld by the Court, the estate may have to pay your legal fees. If you don't contest the distribution before discharge from probate, you may be barred from later asserting your claim. The Executor has the responsibility to strictly distribute the property according to the wishes expressed in the Will, regardless of his own opinion regarding your divorce or residence, but making your claim in court may be your only alternative.
