My Father's is gravely ill and certain issues have arised. He has a will in which he is leaving everything divided amongst his kids, stepkids and wife. His kids are from his two previous marriages, including me and he also adopted two children from his present wife. I recently visited my father and his wife was telling me that she wants to payoff the house with the money my father has on his savings. My father's assets are 30,000.00 in savings and the house of which he owes around 20,000.00 My question is, If my Father dies does she has the right to do stay with the home, pay it off and not divide the inheritance? Is that legal in the state of Florida?

Your father's wife has preferencial status in participating in his estate. He cannot even "disinherit" her in his will. His soon to be widow will have to live on what is left, and she is protected by the law as well. My sympathies to your family with this situation. Please dont make it more difficult by making an issue of money.
