What interest do the surviving heirs ( two sons) have in real property that is passed intestate?

If property was homestead it passes outside probate after court rules on its status. Intestate heirs take ownership by operation of law.

Depends. On whether it is homestead, whether there is surviving spouse and whether there are other surviving heirs (i.e, grandchildren by deceased child). Long story short is you need to talk to a lawyer with the details.
