IRA beneficiary after death

My ex-husband named me as his beneficiary on his IRA. He recently passed away. The financial institution's legal dept. is saying that I have to be named as Executor of his estate by a judge in order to have the money transferred to my IRA. Also, the financial institution changed hands and names last year. The beneficiary designation is on the previous institution form. Is there any legal reason for them to hold up transferring these funds?
