Legal Question in Wills and Trusts in Florida

Keeping Medicaid eligibility with inheritance

What course of action must I take to insure my continued Medicaid and Medicare eligibility, should I receive an inheritance? Would I need an attorney that specializes in Medicaid/Medicare to handle this? And, if so, how much money would this entail? I live in Palm Beach County.

Medicare eligibility is a complicated subject. You should indeed consult an elder law or estate planning attorney to talk about your assets and what would and would not be exempt.

Re: Keeping Medicaid eligibility with inheritance

Medicare is different than Medicaid. Medicare is NOT based on financial status. Medicaid is. Receiving any funds or property can impact your medicaid eligibility, including an inheritance. With proper Medicaid planning you can avoid losing your Medicaid eligibility. Depending on the specifics of your situation, there may be different options available, i.e. setting up a Special Needs Trust. Due to the complexities involved and ensuring that such a trust is set up correctly, I strongly recommend you consult with an attorney that does Medicaid Planning in your area.
