Legal Question in Wills and Trusts in Florida
Leave my home to my children
My mother-in-law is married and has a home. She and her husband agreed to leave the home to her children instead of her husband. What documents will they need to file to make this legal?

This is a complicated issue and they would need to see an estate lawyer. The spouse, upon the death of the other has certain rights a life estate) in the home.

That's a complicated question which definitely requires a meeting with a lawyer. A will alone will not work, and there are pros and cons to other routes, such as deeds and contracts. It certainly is doable, but more information is needed to determine how to carry out those wishes.
