Legal Question in Wills and Trusts in Florida

legal fees to fight will contest

My husband of 15 yrs passed away, leaving the majority of his estate to me. My grown step-children who were never fond of me, are using every delay tactic, to keep me from receiving anything my husband left me. My attorney fees to respond to everything from filing false reports accusing me of everything from murder, abuse, forgery, all of which has been proven unfounded, have left me pennyless. Their attorney's just keep coming up with something new, everytime they fail at a previous accusation. The only ones getting any money from this is the lawyers. Is there any way I can be reimbursed for all the legal fees that these step-children have caused me? I have done nothing wrong, but it's costing me a fortune to defend myself. The estate is large, but I have been reduced to food stamps. Is there any hope for someone like me. I sometimes want to just give up and be with my husband.

Since I assume you are being represented by counsel it would not be appropriate to respond. I suggest you speak with your attorney.

I am really sorry about your situation. I hope you find the strength to hang on tight.

The court should be able to allow the attorney's fees to come from the estate even if it is not yet distributed. Talk to your present attorney about asking the court to do that rather than draining you of the few assets you have. Best of luck.
