Legal Question in Wills and Trusts in Florida

Liability for decesed Aunt's Credit Card or hospital bills

My aunt recently died and I have been named the executor for her limited estate. She also left everything to me and my wife. She had a small home with furniture and presonal belongings, none appear to be of significant intrinsic value. She also left several credit card bills.

Am I responsible for paying those bills?

What should I provide to her creditors?

Do I have to sell her furnishing to pay the bills?

If she left a will with her attorney and there is no money in her estate, Am I responsible for his fee?

Re: Liability for decesed Aunt's Credit Card or hospital bills

In order for you to receive the benefits your aunt wished for you, you must probate the will. You are NOT personally responsible for the debt. We can file a motion with the court to declare the residence as homestead and eliminate the claims. As custodian or personal representitive, you must deposit the will with the court within 30 days of her death or your locating the document. The responsibilty for legal fees is the Estate's...as you are the sole beneficiary, that's you.
