Legal Question in Wills and Trusts in Florida

Life estate

My daughter and I have inherited a house from my husband who recently died.

I am told that because of my age I have a 93% interest in the home and she has 7%. My question is, am I able to pay that 7% off to my infant daughter now(she is 9 months old and I am legal guardian)and if I did that would it remove her from the interest and life estate that she has in the home.

Re: Life estate

I am so sorry about the loss of your husband.

It seems as though you have a life estate and your daughter a remainder interest. As such, you can probably petition the court as your daughter's natural guardian and ask that you be allowed to purchase your daughter's interest. You will have to get an attorney to represent you in this matter and a guardian at litem will be appointed to protect your daughter's interest. I believe it is feasable. Good luck.
