Legal Question in Wills and Trusts in Florida
life estates
My wife died in 1995 leaving a mobile home and the property it sits on. She and her former husband owned it together. He died first. We were married for 5 years before she died. She has 3 grown children. I have re-married and live in another home, but use the mobile home as my place of business. A will was produced this month by her
children stating that I can use said property only if I maintain varies types of Insurance and pay property taxes. I have paid all taxes but maintain no insurance. They now claim I must vacate the premises or purchase the property from them. Is this true?

Re: life estates
Your rights will depend on the exact language of your late wife's will. If you have a life estate on property which you do not insure, in violation of the terms of the life estate, the holders of the "remainder interest" may be able to bring a court proceeding for "partition" -- to have the property sold and the proceeds divided between you and them.
