Legal Question in Wills and Trusts in Florida

life insurance retirement beneficiaries

My husband and I were going through a divorce and living apart when he died. Prior to his death he changed the beneficiaries on his life insurance and his retirement accounts. I have been told these 'assets' are not part of his estate and I am not entitled to the proceeds. Is this correct? How can I challenge this?

Re: life insurance retirement beneficiaries

You need to file a Notice with the probate court of your intention to take your elective share of the estate. I suggest you speak with an probate attorney. Feel free to call me if you have any further questions.
