Legal Question in Wills and Trusts in Florida

Making a Will

My wife and I would like to make out our wills. We have 3 children, 2 married adults and 1 that will be 18 shortly. The 18 yr old has a learning disability.

We see some free will forms on the internet. How legal are these? Do we have to go to a lawyer to make these out? If we just have them notarized and witnessed, it this okay? Also, if we notarize a blank sheet of paper in which we can continually add things to the will, is this legal?

Re: Making a Will

The do it yourself package would not have the proper forms for your child with a disability. you should see a qualified fl estate planning attorney as We are. Located on St Rd 200 at SW 60th. There appears to be a need for a supplemental need Trust for your disabled child which could be handled by one of the other children Just to make sure the 18 yr old is protected. This could be built into your Will or created separately. Contact our office. The other problem you face is that very few notaries will notarize a Will unless they have the knowledge and skill required to perform the proper ceremony.
