Legal Question in Wills and Trusts in Florida
Mom died in 1992..I have been living in her house since. I have mamaged to redeem tax notes so property is still mine..It has never been put through probate, due to 5 other siblings. people are buying the tax notes..i am agin faced with redeming them ..what should I do first? Pay taxes NOT in my Moms name, or push this through procate? If the property is in probate, can tax notes be sold?

Did you mom leave a will? If not, then the surviving siblings are the heir to the property. As long as the taxes on the property have been paid, there should be no tax notes - I am confused? If there is a will then deposit it with the clerk of court's office along with her death certificate so that the property can be listed in the names of the siblings. YOu each can buy the other out until only one ownes the property otherwise, divided the tax bill among all of you. Expect that some one is going to want rent.
and go to probate so someone can obtain title.
