Legal Question in Wills and Trusts in Florida
MY Mom died 6/20/09 and did not make a will which she have a house she do not have a spouse just myself and my Brother . And we cannot come to an agreement to pay the Mortage there is no payment made since July I hate to see the house go I dont know what to do my Brother is no help he told me there is nothing we could do the house is not in our name. You may be right. Probate the estate. The court will appoint a Personal Representative who can put the house in your name. You can then sell and share the proceeds. You would be credited with any payments you make. I can help with the probate and advice. Good luck.
You need to probate your mother's estate. If she did not have a will or a husband, the house should go to you and your siblings. Contact the court clerk in your county or call an attorney for additional assistance. I would be happy to help.
