Legal Question in Wills and Trusts in Florida
Mom dying, no clue of new will
I am the only child of my parents. 5 Years ago my mom gave me a copy of a will leaving all to me & my heirs. Since then mom and I have become estranged barely talking, she said she would give everything to ''salvation army'' She has a spending problem and has been spending all of my parents joint holdings. She is now in Intensive care not expected to live, dad and I have found thousands in her name only. I do not know (nor does dad) if she indeed has another will. Should I just file the one I have? Also I have found several unmarked safe deposit keys, can my dad or I as survivng spouse open and recieve the contents under this will?

You can probate the will you have. Retain Florida counsel.

Your dad, as the surviving spouse, can get the probate estate opened. You will need a court order to get the safety deposit boxes opened.
