Legal Question in Wills and Trusts in Florida

My mom has told me that when she dies I'll receive her condo according to her will. She wants to make a change where if I get married, then I will have to move out. Can she put a legal clause in her will to do this and is this enforceable? I think she is trying to do this so that if I get divorced and then die a few years later, that my "wife" would receive the condo. I don't think she wants my future wife to inherit the condo according to my future will and testiment.

If that is your mother's concern, then I would advise her to put the condo in to a trust for your benefit. This would prevent your potential future wife from ever receiving title to the condo. Also, please consult with an attorney due to the spousal homestead rights. Please contact my office is in Boca Raton, Florida and my phone number is (561) 961-5462.
