Legal Question in Wills and Trusts in Florida
My mother passed away almost 3yrs ago. She had no assets at the time of her death so no probate was filed. However, when she died in her checking account was $3,000.00 As her sole heir, is there anyway to recover the money from the bank account.

You will need to file a probate of her estate.

Yes, You need to file a Summary Administration Probate Proceeding. It is really quite easy, but does require the services of an attorney to do.
You will need the information about the bank accounting and her death certificate (I assume there is no Will and if so, that would also be needed).
