Legal Question in Wills and Trusts in Florida

my mother recently passed away and wished to be cremated and have her remains spread. she was married and her husband is not fulfilling her wishes. i have her remains in my possession and plan to spread them on christmas with my brother. the issue is that she has no written will or last testimony, but she made it very clear what her wishes were to everyone she knew. he has threatened to press charges against me involving grand larceny or grand theft. is he able to do that?

Try to work it out. Maybe you can agree to spread a portion of her ashes and return the rest to her husband.

Without a will you are obligated to return the ashes to her husband. It is his choice.
