Mothers Legal Name Not Used

When Mother was admitted to Nursing Home,her brother used a different last name.He passed away,never explaining why this was done.Now Mother has passed and Death Certificate has this name. Mother was never able(mentally) to sign herself.She was widowed at the time of her death and had always used her late Husbands name,not what was on Death Certificate.

Would this be considered ''Fraud''.

His Widow I'm sure was aware of this transaction.

Can the Survivors take Legal Action?

Whether there is a cause of action would depend on many things including your uncle's intent and whether he gained anything by doing this. Since your uncle has passed, it would be difficult to find out and what you would gain is not clear.
