Legal Question in Wills and Trusts in Florida

Nursing Homes and a Patient bank account and assets

I have a friend whose mon has alsheimer disease. Whe was living in Florida and had a joint bank account in her name and her daughter's name who lives in Florida. She has not moved in with one of her other daughters living in Alabama. If she has to go into a nursing home, will the nursing home have legal right to that money? Would they be better off spliting up the money new before that happens?

Re: Nursing Homes and a Patient bank account and assets

When someone moves into a nursing home, the nursing home has them fill out financial documents. This is to determine if they have money to pay for rent, food, etc., or does medicare and medicaid pay. If someone has accounts in their name then this would have to be put down on the financial documents and the nursing home would have the right to seek payment. This is put very simply and you should contact an attorney in your area to discuss this further.
