If the grandparents cannot settle the issue, a court will be responsible
for determining the best interests of the child. Whether the mother was
intestate is not an important issue unless the father's will designated
specific guardians for the child. General set of facts which will require
a review by an attorney for counsel.

So sorry for your loss. Either work this out or The court will base its decision on who had the most contact with the child. I suggest if you did that you get this to court immediately. This child is suffering and will need a lot of supoort.
