Legal Question in Wills and Trusts in Florida
Hello, both parents have passed, oldest sister is first trustee, she has not distributed the assets of the trust, she lives in Ohio. She does have an address here in Florida, I plan to file beach of duty against her, do or should I file it in the county I live in or where my parents lived. I did send notification (personal certified mail), that she was in breach, she refused two of three, the third went to her place of work so I know she received. She sent it back unopened. help please.

Get an attorney. Trusts are not filed on the public record. You need to have her dismissed as a Trustee and have the next trustee to be placed in that position. If she wishes to withdraw from her fiduciary duties she only needs to state so and file that on the public record.
