If someone passes away without a will does everything go to the children? Or can family members pick and choose what they want?

If someoe dies without a will, it passes according to the intestacy statute. How that gets disbursed depends on whether the decedent was married at the time of his death, and who the relatives are.

But no, family members generally cannot just take what they want.
